Suspended Chief Justice of Ghana, Gertrude Araba Esaaba Torkornoo, has broken her silence on the controversy surrounding her suspension and the petitions for her removal. Speaking at a press conference on Wednesday, June 25, 2025, she categorically ruled out resignation or early retirement, saying such actions would be unconstitutional and would suggest guilt.

“Resigning is not an option,” Justice Torkornoo declared. “I have received calls from well-meaning individuals urging me to step aside, but doing so would be running away from the very process I am prepared to face.”

She disclosed that she has even received threats—both direct and veiled—warning her of personal consequences should she refuse to resign voluntarily. Yet, she remains undeterred.

“Resigning or retiring while Article 146 proceedings are ongoing is not even a legal option available to any judge or public officer. The Supreme Court has ruled on this already,” she asserted.

Her remarks come after President John Dramani Mahama suspended her from office following a prima facie determination that warrants a full investigation into her conduct. A five-member committee has been appointed to probe the three petitions lodged against her.

Meanwhile, the Supreme Court has unanimously dismissed her application for an injunction against the investigative committee and struck out her supplementary affidavit for violating confidentiality provisions under Article 146 of the 1992 Constitution.

This legal and political drama marks an unprecedented moment in Ghana’s judicial history, as it involves the sitting Chief Justice facing multiple removal petitions while refusing to back down.

“I believe in the rule of law. I believe in due process. And I will face the committee, not out of defiance, but out of duty,” she concluded.
