The High Court has dismissed an ex parte injunction filed by NPP parliamentary candidate Nana Akua Afriyie, which sought to stop the Electoral Commission (EC) from conducting a rerun in 19 polling stations within the Ablekuma North Constituency on Friday, July 9, 2025.
The legal team for Nana Akua Afriyie, led by lawyer Gary Nimako, argued that the Electoral Commission failed to comply with an earlier High Court directive from January 4, 2025, which instructed the EC to collate and declare results from only three outstanding polling stations, not 19.
“Even in Parliament, under oath, Dr. Bossman Asare stated there were only three polling stations left to be collated,” Nimako told the court.
According to the application, the 10-day ex parte injunction was intended to give the NPP candidate time to serve the EC with an application seeking further explanation on their actions.
However, Justice Ali Baba Abature dismissed the injunction, ruling that it was “unmeritorious” and contrary to the constitutional rights of the people of Ablekuma North.

“The balance of convenience tilts in favour of the respondent [EC] who has the constitutional mandate to conduct elections… which is the people’s right to parliamentary representation,” Justice Abature stated.
He further noted that should Nana Akua Afriyie eventually win the substantive case, she could be compensated with damages, thus validating the EC’s continued right to proceed with electoral activities.

With this ruling, the Electoral Commission is now cleared to proceed with the rerun of the 19 polling stations, aimed at resolving the lingering dispute in the Ablekuma North parliamentary election.
