The Kumasi High Court 5, presided over by Her Ladyship Justice Dorinda Smith Arthur, has adjourned the hearing of an injunction application filed by Akosua Serwaa to October 28.
The case centers on Serwaa’s demand to be legally recognized as the only surviving wife of the celebrated highlife legend.
In her suit, Akosua Serwaa is asking the court to declare her as the lawful and surviving spouse of the late musician, granting her exclusive rights to perform the widowhood rites.
She also seeks an order restraining the head of the Lumba family, Kofi Owusu Fosu, from recognizing or dealing with the second defendant, Priscilla Ofori Atta, popularly known as Odo Broni, as a wife of the deceased.
The plaintiff further wants the court to stop Odo Broni from publicly presenting herself as the surviving spouse of Daddy Lumba, emphasizing that she alone was legally married to him.
During Thursday’s sitting, counsel for the first defendant challenged Akosua Serwaa’s legal capacity to file the action, urging the court to make a determination on that issue before proceeding with the substantive matter.
Justice Dorinda Smith Arthur also drew attention to an appearance application filed by both parties and directed their lawyers to file all responses and supporting documents by October 28, the new date set for hearing.
Before adjourning the proceedings, the presiding judge urged both sides to consider an amicable resolution, stressing the need to preserve the legacy and dignity of the late Daddy Lumba, whose contribution to Ghana’s music history remains unmatched.
